SITE WASTE MANAGEMENT PLANS (SWMPS)
Since 6th April 2008 it has been a legal requirement for all construction projects in England with a value over £300,000 to have a SWMP. A more detailed plan is required for construction projects over £500,000.
These plans are designed to encourage better waste management practices, improve environmental performance, reduce the cost of waste disposal and reduce waste crime, such as fly-tipping which costs over £100m per year to deal with in the UK.
Both local authorities and the Environment Agency have the power to enforce the SWMP Regulations. Both BREEAM and the Code for Sustainable Homes require a compliant SWMP containing certain information. Penalties for not preparing and implementing a SWMP in line with SWMP regulations includes a £300 fixed penalty notice or up to £50,000 fine if found guilty.
